Thebeautysampler.com is a retailer of cosmetic products.  While we provide products purchased through authorized brand retailers, we are not affiliated with any other corporation or business entity. 


Copyright and Trademark Agreement
The contents of our website, including all text and web copy, product photos, any and all other graphics, and all designs, are protected by copyright and are the property of Thebeautysampler and/or the property of the business systems we incorporate to provide services online (Intuit, Paypal).  All rights are reserved.  All trademarks, service marks of Thebeautysampler used in the site are trademarks or registered trademarks of Thebeautysampler.

Indemnification
You agree to indemnify, defend, and hold harmless Thebeautysampler, its owners, directors, employees, licensors and suppliers from and against all losses, expenses, damages and costs, including all attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or illegal conduct) by you or any other person accessing the site using your registered account.  In the unlikely event that a problem should arise with any unauthorized activity, we shall, in good faith, take all necessary steps to rectify the situation, including reimbursement of funds, and transmission of data and information to authorities relevant to any criminal investigation. 

Regarding termination of terms and conditions agreement
All terms and conditions are applicable to all users of the contents of the website provided by thebeautysampler.  We reserve the right to modify or terminate any portion of or all information, policies contained with our terms and conditions agreement, without notice.  We do provide updated information to all customers, past or present, regarding changes to privacy or security policies that affect how we use, manage, or collect personal information.  Any and all copyright, trademark, liability protections, indemnifications shall remain in effect (as allowed by law) regardless of any modification or termination of any or all parts of our terms and conditions agreement. 

Refusal Policy
We reserve the right to refuse products and service to anyone, at any time, for any reason.  All paid funds from purchased orders that we decide not to process will be returned to the purchaser immediately.  We greatly appreciate your business and we thank you for choosing Thebeautysampler.
 
In the event that a price for any product or promotion code listed on our website is mistakenly listed at an incorrect price or discount percentage, Thebeautysampler reserves the right to refuse, cancel or honor any orders placed for such product(s) listed at the incorrect price. Thebeautysampler reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.  If your credit card has already been charged for the purchase and your order is cancelled, Thebeautysampler shall issue a credit to your credit card account in the amount that was charged.

User Participation Agreement
Thebeautysampler does not and will not review all communications posted to or created by users accessing Thebeautysampler.  Thebeautysampler is not legally responsible for the communications or contents of user generated content.
 
Thebeautysampler is providing a medium for the dissemination of communications between users accessing our website.  You wholly agree that for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. Thebeautysampler provides services on the basis that all communications between you and Thebeautysampler, its customers, adhere to a professional standard of courtesy, respect and concern for the protected rights of all parties involved; whether communication is conducted by email, posting, or feedback submission.  We prohibit the use of profanity, abusive, or otherwise threatening language.  We prohibit the uploading or posting of any content of any kind to Thebeautysampler that we deem to be libelous, defamatory, obscene, threatening, and invasive of the rights and privacies of other users, or otherwise objectionable material which may constitute or encourage a criminal offense.  We reserve the right to delete or remove solicitations from posted for business or entities that are not preauthorized by Thebeautysampler.

Product Imagery Notice
As part of our mission to improve our website, we incorporated the use of professional photography and lighting to display the contents of product samples as a means to enhance the visual and physical description of each pigment.  However, due to photography lighting and the nature of digital display, actual product appearance may differ slightly from photos displayed on our website.
